These Terms of Service explain how Elevate Marketing Studios provides its products and services and how you may use them. By purchasing, accessing, or using anything from Elevate Marketing Studios, you agree to these terms.

What we offer

We provide website templates, trainings, and support resources designed for service based, portfolio driven businesses. We also offer semi custom website builds and custom website design on Squarespace. We also sell digital products and 1:1 coaching.

Eligibility

You must be at least 18 and able to form a contract. You will use our products and services for lawful business purposes only.

Accounts and access

Some materials are delivered through private links, a course portal, or shared documents. Keep your login and access links private. Do not share, resell, or publicly post our training materials or downloads.

Orders, delivery, and timeline

Digital products are delivered within 24 business hours after purchase. Purchases made Friday night through Sunday are delivered Monday morning. Service timelines are estimates and depend on your responsiveness, content, and approvals.

Pricing and payment

Prices are shown at checkout or in a written proposal. Payment is due at purchase for digital products. Service projects may require deposits or staged payments set out in your invoice or proposal. You are responsible for any taxes, bank fees, or currency charges.

Third party services and fees

Our work is built on Squarespace unless stated otherwise. You are responsible for third party accounts and fees such as Squarespace hosting and your domain. Typical costs are under 30 dollars per month for Squarespace hosting and around 20 dollars per year for a domain. Third party tools are governed by their own terms, and we are not responsible for their availability or changes.

Cancellations and refunds

Because templates, trainings, and other digital products are delivered electronically, all sales are final and non refundable. For services, any cancellation terms will be stated in your proposal or invoice. If no terms are stated, deposits are non refundable, and time already spent is billable.

If you believe something was delivered in error, contact us. We review requests case by case and may offer support to help you complete your website.

License for templates and training materials

When you buy a template or digital product, you receive a single business license. You may use and modify the files for your own business website. You may not
• Resell, share, or distribute the template or training files
• Claim the template design or course content as your original work
• Use one license for multiple brands or client projects

Agencies and designers need one license per end client. Ask us about extended licensing if needed.

Website ownership for service projects

Semi custom and custom projects are built on your Squarespace account, which you own and control. After final payment, you own your specific website content and any brand assets you provide. Elevate Marketing Studios retains ownership of its underlying template structures, libraries, training content, and proprietary processes.

We may reuse non unique components and internal methods in future work. If we provide stock images, icons, or fonts, those are subject to their original licenses.

Your responsibilities

To keep your project on track, you agree to
• Provide accurate copy, photos, and brand assets you have rights to use
• Review and approve drafts in a timely manner
• Follow our file and feedback guidelines
• Comply with applicable laws, privacy rules, and disclosures for your business

You are responsible for all content you place on your website, including legal pages, policies, accessibility, claims, and compliance in your industry.

Edit sessions and coaching

Edit sessions and coaching provide guidance and recommendations. You are responsible for final decisions and implementation unless your proposal states that we will implement specific items.

Portfolio use and testimonials

We may show completed work, screenshots, or a link to your live site in our portfolio and marketing unless you request otherwise in writing before launch. If you provide a testimonial, you grant us permission to display it with your name and business.

Acceptable use

Do not use our products or services to publish unlawful, deceptive, or abusive content. Do not attempt to reverse engineer, copy, or redistribute our training materials or code snippets.

No guarantees

We want you to succeed, and we provide clear tools and support. Still, we do not guarantee specific results such as revenue, rankings, or traffic. Outcomes depend on your business, market, and ongoing effort.

Disclaimer of warranties

Our products and services are provided as is and as available. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non infringement.

Limitation of liability

To the fullest extent allowed by law, Elevate Marketing Studios is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is limited to the amount you paid to us for the product or service giving rise to the claim.

Indemnification

You agree to hold harmless and indemnify Elevate Marketing Studios from claims arising out of your content, your misuse of our products, or your violation of these terms or any law.

Changes and updates

We may update these terms when needed. The updated date will appear at the top. Continued use after a change means you accept the new terms.

Project specific terms

If you receive a proposal, statement of work, or invoice with additional terms, those terms apply to your project. If there is a conflict, the project document controls for that project.

Communications

By contacting us, making a purchase, or creating an account, you consent to receive service related emails and messages. You can opt out of marketing emails at any time.

Governing law

These terms are governed by the laws of the State of Idaho. Venue for any dispute will be in the state or federal courts located in Idaho.

Accessibility and compliance notice

We aim to create clear, easy to use websites. Final compliance with laws such as ADA, CCPA, GDPR, CAN SPAM, and industry specific rules depends on the content and settings you control. We recommend reviewing your legal pages with an attorney and configuring cookie banners, email settings, and data collection tools to match your business needs.

Entire agreement

These terms, together with any project specific documents, are the entire agreement between you and Elevate Marketing Studios regarding our products and services. If a court finds any part unenforceable, the rest remains in effect.
